Talk Visa Limited Referral Protocol
Talk Visa Limited has the following procedure in place for deciding which cases to take on. It is
useful for referral agencies to be aware of the procedure when referring clients to Talk Visa
Talk Visa Limited in order to understand what information we need to make a decision on whether to
accept a referral, and the timescales involved.
Talk Visa’s Remit
- Talk Visa Limited’s specialises in Corporate Immigration work for Employers and Educational Institutions, but also in advising individuals seeking to enter or remain in the UK. Every client is important to us and we are committed to providing an efficient and personal service to all of our clients at all times.
- Talk Visa Limited’s casework team can advise and assist on asylum, immigration, managed migration and human rights claims at all stages of the determination process. However Talk Visa Limited is unable to do High Court work, including Judicial Reviews, or Emergency Injunctions. We specialise in fresh claims and appeals up to the stage of paper reviews to the High Court under section 103D of NIA 2002.
Intake Criteria
- When assessing which new clients to take on for casework and, possibly, representation, Legal advisors consider whether the case satisfies Talk Visa Limited’s criteria:
i. That the case offers a realistic prospect of success
ii. That taking the case on is in the best interests of the client.
Intake Process
- Intake decisions are taken by the Casework Team, at weekly meetings (Wednesdays), on the basis of papers supplied by the potential client or referral agency. In some cases it becomes apparent that full papers or additional papers are needed. In such cases the decision is made to defer the case until the following meeting.
- Talk Visa Limited sends potential clients a standard letter explaining that the case has been referred and an ‘authority to act’ form needs to be signed and returned with acceptance of the Terms and Conditions of Business. We will offer an appointment in an emergency situation.
- Where it is not possible to make a full assessment without further information, including expert or medical reports, Talk Visa Limited will seek such information. In some cases clarification may be needed from the potential client on certain aspects of the case. It is for the Talk Visa Limited Legal advisor to exercise discretion on the best method for achieving that clarification. If a decision is made to take on a case, the relevant Legal advisor will liaise directly with the client making an appointment with the client to progress the matter.
- Talk Visa Limited will deal directly with clients. If consent is obtained from the client, the adviser from the referral agency will receive feedback at the end of the case.
- In cases that, in the view of Talk Visa Limited, do not meet the above criteria, the potential client will be sent a letter informing them of this decision. It is for the client to share Talk Visa Limited’s decision with the referral agency.
- There are times when Talk Visa Limited may not have the capacity to take on a case that satisfies its criteria. At those times, Talk Visa Limited will endeavour to make a suitable referral from our referral list or give the potential client a timetable as to when we can take on their case.
- The referral agency will not enter into discussion about the merit or tactics or conduct of the case with the Legal advisor dealing with the matter. If the referral agency has a concern then it must be addressed to the Managing Partner.
Intake Requirement
- The referral agency will do the following:
- Send relevant clients' papers by fax or post to Talk Visa Limited with a cover note (see list below);
- Send a summary note of the factual history with the client’s contact details and whether there is a deadline;
- Highlight those cases with deadlines and ensure that they are sent FAO of Kahiye Alim;
- The general case papers (i.e. those without a deadline) to be sent addressed to Talk Visa Limited Intake or using the Contact Us form on our website.
- In most cases the type of papers to send to Talk Visa Limited are:
- The Home Office’s reasons for refusal letter
- Records of interview
- Appeal determinations from the Court
- Grounds of appeal at each stage
- The details of the previous representatives
- Any new evidence
- Evidence of accommodation and maintenance according to the requirement of the immigration rules.
